摘要
我国知识产权惩罚性赔偿制度在司法实践中出现了惩罚性赔偿适用比例低、以法定赔偿代替惩罚性赔偿、惩罚性赔偿基数难以确定、惩罚性赔偿倍数主观化异象。计量法学的研究对象是具有数量变化关系的法律现象,计量法学是研究惩罚性赔偿倍数标准的有效因应。文章从3478份知识产权判决书中选取79件适用惩罚性赔偿的判决书进行计量分析。首先明确构成“恶意”和“情节严重”的9项因子,经数据采集、数学优化、异常案件排除、权重系数修正以及验证处理,计算得出惩罚性赔偿倍数的多元线性回归模型。根据该回归模型,惩罚性赔偿倍数与9个因子呈正相关,“侵权范围”“行为人采取措施掩盖侵权行为、毁灭侵权证据”“知识产权客体知名度”是影响惩罚性赔偿倍数最大的前三项因子。
In China,the punitive damages compensation system for intellectual property has exhibited several anomalies in judicial practice,such as a low application rate of punitive damages,the substitution of statutory compensation for punitive damages,difficulties in determining the base for punitive damages,and subjectivity in assessing the multiplier for punitive damages.Empirical legal studies focus on legal phenomena with quantitative relationships,making it an effective approach to address the standards for punitive damages multipliers.This study conducts empirical analysis on 79 selected judgments out of 3478 intellectual property cases where punitive damages were applied.Initially,nine factors defining malice and severity of circumstances are identified.Following data collection,mathematical optimization,exclusion of outlier cases,coefficient adjustments,and validation,a multiple linear regression model for punitive damages multipliers is developed.According to this regression model,punitive damages multipliers are positively correlated with these nine factors,with scope of infringement,measures taken by the infringer to conceal the infringement or destroy evidence,and notoriety of the intellectual property object being the top three factors with the most significant impact on punitive damages multipliers.
