摘要
我国政法院校以司法鉴定学、物证技术学、法庭科学为专业或研究方向培养硕士、博士研究生,这与公安院校培养的刑事科学技术专业研究生有显著区别,形成了人才培养的错位发展格局。前者注重“法学+鉴定技术”,后者突出刑事鉴识技术。然而,由于国家层面上未能对前述学科按各自的特点进行合理设置,在把公安技术学增设为工学学科下的一级学科后,政法院校获得的刑事科学技术硕士、博士学位授权点之间存在学科冲突,因而政法院校的该类学科生存和发展亟待根据培养人才的特点确定新的科学归属。司法鉴定学科的庞大知识体系、法学教育对鉴定技术的轻视以及政法院校资源的有限导致我国司法鉴定学科的发展陷入瓶颈。目前,政法院校司法鉴定学科发展面临名称分散化、定位边缘化、研究成果局限化的难题。故以国家法治建设需求为统领,统一学科名称与学科特色定位,明确学科的独立新文科地位已经成为该学科建设发展的当务之急。本文提出司法鉴定学科培养人才的新模式、明确“法学+鉴定技术”的学科特色、构筑独立学科的共同体发展平台、力争各种资源扶持等思路,以期更好推动该学科的建设发展。
China’s colleges and universities of political science and law cultivate master’s and doctoral students according to the majors or research directions of science of judicial expertise,material evidence technology and forensic science.This is obviously different from the postgraduates majoring in criminal scientific technology cultivated by police colleges,which forms a dislocation development pattern of talent training.The former focuses on the science of law plus expertise technology,while the latter emphasizes criminal identification technology.However,due to the failure to set up the above-mentioned disciplines reasonably according to their respective characteristics at the national level,after the police technology was added as the first-level discipline under the engineering department,there are disciplinary conflicts in the authorization points of obtaining master’s degree and doctoral degree in criminal science and technology in colleges and universities of political science and law.Therefore,the survival and development of this discipline in colleges and universities of political science and law urgently need to determine a new scientific attribution according to the characteristics of cultivating talent.It is the huge knowledge system of judicial expertise,the contempt of legal education for judicial expertise and the limited resources of colleges and universities of political science and law that lead to the bottleneck of the subject’s development in China.At present,the development of judicial expertise in colleges and universities of political science and law faces the problems of name decentralization,position marginalization and limitation of research results.Therefore,it has become an urgent task for the development of discipline construction to unify the name and characteristics of the discipline and clarify the independent new liberal arts status of the discipline under the guidance of the needs of national rule of law construction.Therefore,this paper puts forward some ideas,such as a ne
