摘要
当前我国货币政策法律规制体系具备一个相对完善的顶层设计.但基于总量货币政策的法律规制体系存在一些问题:制度设计无法保证结构性货币政策工具使用的科学性和合理性,中央银行透明度的制度化、系统化建设仍有欠缺,结果导向的政策评价标准无法及时、准确地对结构性货币政策作出科学评价.结构性货币政策法律规制应遵循民主原则和透明度原则.据此,建议强化全国人大常委会对货币政策制定及执行的监督,将透明度纳入法律规制范畴,货币政策委员会的议事结果及国务院对央行货币政策方案的态度及依据应当适时公开,应将货币政策操作误差纳入《中国货币政策执行报告》披露范围.
Though the legal regulation system of monetary policy in China is relatively perfect in top-level design,problems exist in aggregate monetary policy.System design cannot guarantee rationality of the use of structural monetary policy tools,and institutionalization of transparency of central bank still lacks systematic construction.Likewise,the result-oriented policy evaluation criteria do not allow for a timely and accurate access of structural monetary policy,the legal regulation of which should follow the principle of democracy and transparency.Accordingly,it is recommended that the Standing Committee of the National People's Congress strengthen its supervision of the formulation and implementation of monetary policy,and incorporate transparency into the scope of legal regulation.The disclosure of monetary policy operation errors should be included in the disclosure scope of China's Monetary Policy Implementation Report.
