摘要
公共图书馆地方立法在推动公共图书馆事业法治化发展中发挥了重要作用。从立法理念、立法原则、主要任务、现存问题四个方面进行分析发现:在立法理念上,应以人民为中心设立、运行公共图书馆,以人民为中心开展公共图书馆服务;在立法原则上,应以解决问题为目标,以推动公共图书馆事业现代化发展为导向,必须关照公共图书馆的地方性,强化法律的可操作性;地方立法的主要任务是提高地方人口素质和社会文明程度,保护、传承和发展地方文化,构建地方公共图书馆服务体系,为地方公共文化事业高质量发展提供法律保障;针对仍存在的问题,建议依法建立公共图书馆投入机制,依法建立公共图书馆馆长专业素养保障机制,依法保障公共图书馆独立法人资格。
The local legislation of public libraries has played an important role in promoting the legal development of the public library industry.Through analysis from four aspects:legislative philosophy,legislative principles,main tasks,and existing problems,it is found that in terms of legislative philosophy,public libraries should be established and operated with the people as the center,and public library services should be carried out with the people as the center;In terms of legislative principles,the goal should be to solve problems,guided by promoting the modernization of the public library industry,and must pay attention to the locality of public libraries and strengthen the operability of laws;The main task of local legislation is to improve the quality of the local population and the level of social civilization,protect,inherit and develop local culture,build a local public library service system,and provide legal protection for the high-quality development of local public cultural undertakings;In response to the existing problems,it is recommended to establish a public library investment mechanism in accordance with the law,establish a professional competence guarantee mechanism for public library directors in accordance with the law,and ensure the independent legal personality of public libraries in accordance with the law.
