摘要
“影像传输型猥亵”具有不同于传统猥亵犯罪的独有特点,引发入罪的“肯定说”与“否定说”之争。然“两说”均以“影像传输型猥亵”共性的不同侧面为着眼点,对司法实践的指导意义有限。基于功能主义与目的理性的现代刑法理念,“影像传输型猥亵”的妥当刑法评价,应以传输影像是否包含受害者的性敏感部位与可识别身份的面部信息为着眼,全面适用《刑法》分则关于猥亵犯罪、淫秽物品犯罪、侮辱罪等罪名,结合各罪的规范保护目的,构建类型化的刑法适用体系。
Indecency crime by means of"image transmission"bears the unique characteristics different from the traditional ones,causing the"affirmative"and"negative"dispute of its criminalization.However,the disputes only focus on the different aspects of"image transmission indecency",thus have limited guiding significance to judicial practice.Based on functionality and rational purpose of modern criminal law,the appropriate criminal law evaluation of the"image transmission indecency"should consider whether the transmission image contains sensitive parts and facial information of the victims,fully applying obscene crime and insult crime,etc.,combined with the crime of the specification protection purpose,so as to build a classified applicable systemofcriminal law.
