摘要
行政协议中的缔约信息较之一般政府信息,在信息所有人、信息收集方式、信息提供范围、形成的信息利益关系等方面,呈现出一定的特殊性与复合性。现有法律规制强调行政主体的监管职责,在公开等环节的信息处理要求上存在矛盾。其管理规定不仅倾向长期利用,而且标准模糊,从而与个体的信息自决主张发生冲突。而明确行政主体和缔约参与者的信息控制界限,是缔约信息得到合理处置的前提。因此,需从行政主体信息控制权限、缔约参与者信息自决让渡范围、主张冲突时保障顺序三个争议点入手,系统分析信息控制的实质要求,最终将信息竞争价值、缔约深入程度与公共利益关联度作为界限划分的衡量因素。
Compared with the general government information,the contracting information in the administrative agreement shows certain particularity and complexity in the aspects of information owner,information collection method,information providing scope and information interest relationship.However,the existing legal regulations emphasize the supervision responsibilities of administrative subjects,and there are contradictions in the information processing requirements of disclosure and other links.The management provisions are not only inclined to be used for a long time,but also the standards are vague,which conflicts with the individual’s claim of information self-determination.Clarifying the information control limits of administrative subjects and contracting participants is the premise of reasonable disposal of contracting information.Therefore,it is necessary to systematically analyze the substantive requirements of information control from the three disputed points of administrative subject’s information control authority,the scope of information self-determination transfer of contracting participants,and the order of protection when claiming conflicts,and finally take the value of information competition,the depth of contracting,and the degree of correlation with public interests as the measuring factors for demarcation.
