论教育法法典化的现实基础与实现路径

On the Realistic Foundation and Realization Path of Codification of Education Law

摘要 当前我国已进入法典化时代,教育法典编纂已经提上了日程。教育法法典化在我国有着充分的现实基础,一方面源于现有法典编纂和教育立法的经验积累,另一方面则源于我国当代教育法学理论的日渐纯熟。教育法典编纂具有深远的意义,既能够整合我国当代教育法治理念、完善教育法律规范体系,亦能够提高教育领域的治理水平,推动我国教育法学理论发展到新的高度。在教育法典的编纂过程中,应当确立教育法典“以人为本”的价值定位及其管理法兼保障法的性质,继而对现有的教育法律体系查缺补漏、清理整合,最后遵循一定的编纂线索分别对总则和分则进行体系化展开。 At present,China has entered the era of codification,and the codification of education law is already on the agenda.The realistic foundation of codification of education law stems partly from the experience accumulated in the codification of the Civil Code and education legislation,and partly from the increasing sophistication of the science of education law.The codification of education law also has its far-reaching significance,which can not only integrate the concepts of the rule of education law,improve the educational legal system,but also improve the level of governance in the field of education,and promote the development of the science of education law to a new level.In the process of codifying the education code,we should recognize the“people-oriented”value of the education code and its legal character as a management law and protection law,and then check what is missing,fill in the gaps,clear up and integrate the existing education laws and finally accomplish the general principles and subdivisions following some certain codification clues.
