摘要
多国在可再生能源改革中遭遇群发性的投资仲裁纠纷,针对裁决的反执行行动值得反思。以西班牙为代表的当事国反复申请对裁决的反执行禁令,不仅难以达到特殊临时措施的高门槛,还造成司法不经济和对国际投资仲裁机制的道德压力。欧盟依据欧盟法反复干预针对成员国裁决的执行,其正当性存疑。可再生能源投资仲裁裁决极其反常的执行困境,深刻暴露出能源转型过程中相关域内法与国际法的冲突以及传统国际投资条约的不足。国家在追求能源转型目标的同时须增强域内法与国际法的协调性,国际投资条约也亟须深度转型,从而与全球气候目标相向而行。为应对现有的僵局,当事国可以考虑与相关投资者进行和解谈判,在不挑战裁决的前提下寻求双方均可接受的方案。
Energy transition has triggered mass claims of investment arbitration with concerns about the legitimacy of anti-enforcement actions against these awards.Applications for anti-enforcement injunctions initiated by energy reformers such as Spain have not only made it difficult to meet high threshold of such interim measures,but also have caused judicial diseconomy and ethnical burden on international investment arbitration system.The intervention by the European Union on the grounds that fulfillment of investment incentive-related awards would constitute state aid and intra-EU investment agreements are invalid under the European Union law is proved to be unjustified.By learning from the lessons,potential energy reformers have to coordinate domestic law and international investment agreements more effectively,and to improve the inclusiveness of energy transition under future international investment agreements.To solve the dilemma of anti-enforcement actions against energy transition-related mass investment awards,spain and other EU member states may consider negotiation for settlement with relevant investors,without challenging the awards ceaselessly.
