摘要
法治应为良法之治,良法的核心在于法的价值理念借好的立法技术得以普遍认同。在社会变迁中,旧法的保守与滞后造成制度的非均衡和社会的不和谐,良法应对法的价值理念嬉变作出因应,以制度创新实现新的制度均衡。《治安管理处罚法》正是转型时期体现权利本位理念的一个立法范例。
With transitions of the society,the obsolete law caused unbalanced regulation and the society's disharmony.A good law should react to the evolution of the value of law,to realize a new balance through bringing forth new ideas in the law.Law of the People's Republic Security Administration Punishments is a good example which embodies the right standard in the transition period.
