摘要
贸易的数字化正在推动商品和服务的生产、交换和消费的深刻变化。随着数字贸易逐渐成为国际贸易的重要组成部分,数字贸易规则便成为当前国际贸易规则重构的关键议题。在分析中国数字贸易规则现有水平的基础上,通过与其他数字贸易规则的比较,为中国高标准数字贸易规则的制定提出新策略。中国在构建数字贸易规则时,应以监管合作为目标,建立并完善相应的国内规制体系。在争议性较大的数字贸易议题方面努力探寻中国方案:对内实施“扩大跨境数据流动先行试点范围+逐步完善国内数据治理体系建设”的模式,对外有条件地逐步有序开放跨境数据流动;采用“数字产品概念+负面清单+例外条款具体化”的措施;进一步明晰数字知识产权议题中例外条款的具体范畴;对标高标准金融科技合作、人工智能等新兴技术领域的国际规则。
The digitization of trade is driving profound changes in the production,exchange,and consumption of goods and services.As digital trade has gradually become an important pillar of international trade,digital trade rules have become a key issue in the reconstruction of current international trade rules.On the basis of analyzing the current opening level of China's digital trade rules,this paper puts forward a new strategy for the further opening of China's digital trade rules by comparing the provisions of several digital trade agreements.When constructing digital trade rules,China should aim at"regulatory cooperation",improve domestic rules and strive to explore Chinese solutions on controversial digital trade issues:Carry out the model of"expanding the scope of cross-border data flow pilot+grad-ually improving the construction of domestic data governance system"domestically,and gradually and orderly open cross-border data in a conditional manner externally;Through the regulatory cooperation mechanism,deepen the"concept of'digital products'+negative list+exception clause concretization"model;Under the framework of regu-latory cooperation,the specific scope of exceptions in digital intellectual property issues will be further clarified;Setting high standards for international rules in emerging fields such as fintech cooperation and artificial intelligence.
