摘要
健全完善的破产法律制度是法治化营商环境的重要组成部分。近年来,我国对照世界银行营商环境评估指标所推行的破产法律改革取得良好成效,强化了我国破产法律制度的完整性和充实性。2023年,世界银行发布商业成熟度评估项目(B-READY)替代了原营商环境评价项目,新指标将从规范框架、公共服务和整体效率三个维度评估企业办理破产的营商环境,且在评估目标、指标设置和评估方法等方面均有重大变化。为积极应对评估工作,有效提升办理破产营商环境,我国应当根据新指标变化情况,全面研判并补足潜在失分项,既要客观看待评估体系的变与不变,保持法律的可预期性和相对稳定性,又要提前布局、统筹做好破产领域的营商环境优化工作。
A sound and complete bankruptcy legal system is an essential part of the business environment.In recent years,China's bankruptcy law reform in accordance with the World Bank's Doing Business(DB)project has achieved good progress,and the indicator of"resolving insolvency"has made remarkable progress and ranked high,which strengthened China's bankruptcy legal system.In 2023,World Bank released Business Ready(B-Ready)project to replace the former Doing Business project,the new indicators will assess the business environment for bankruptcy in three dimensions:regulatory framework,public services and efficiency,and there are significant changes in the project goals,indicator settings and methodology.In order to actively respond to the new changes and effectively improve the business environment for bankruptcy,China should be aware and ready for the potential losing points according to the new indicators,not only objectively looking at the new project,keeping the law predictable and relatively stable,but also improving the business environment for bankruptcy in a more integrated manner.
