摘要
司法责任制是本次司法改革的重点,法官司法责任制又是司法改革的重中这重,正当程序是使法官司法责任制改革真正落到实处的关键,因为只有用正当程序才能规制住审判权的恣意,才能够让人民群众在每一个司法案件中感受到公平正义。文章以正当程序理论为主线,结合我国现有的程序立法和审判实践,提出增设快速封闭连续审判程序,创立有限多元人民陪审团制度,同时注重完善法官职业保障,力图构建具有中国特色的社会主义正当审判程序,在最大限度上遏制司法腐败,实现司法的公平与正义。
The key of judicial reform is judicial responsibility system,and the system of judicial responsibility of judges is the most important part of judicial reform.Only with due process can the arbitrariness of judicial power be regulated,and at the same time,only with due process can make the people feel fair and just in every judicial case.The article takes the due process theory as the main line,combining the existing procedural legislation and trial practice in our country,and then the author puts forward the idea of adding the fast-closing continuous trial procedure and establishing the limited and pluralistic people jury system.Trying to build a proper trial procedure with Chinese characteristics,to curb judicial corruption to the maximum extent,to achieve fairness and justice in the judiciary.
