摘要
中国与“一带一路”共建国家之间的国际投资协定中有些属于不利于投资保护的保守型协定和片面有利于投资保护的自由型协定,另有许多国家尚未与中国缔结国际投资协定。这不利于平衡保护东道国利益和投资者利益。“一带一路”倡议实施十年来,中国积极推进国际投资协定的升级换代,取得了重要进展,谈判达成了许多具有可持续发展导向的新一代平衡型国际投资协定。但是,新一代国际投资协定占比仍然较小,中国仍然需要持续积极推进国际投资协定的升级换代。此外,中国新一代国际投资协定也需要进一步升级,公平公正待遇、最惠国待遇等实体条款需要进一步完善,可持续发展维度需要进一步加强。因此,中国应该积极探索契合“一带一路”倡议、体现中国发展和现代化成功经验的国际投资协定范式。
Some international investment agreements between China and the countries jointly building the Belt and Road are conservative agreements that are not conducive to investment protection, and liberal agreements that are one-sided in favor of investment protection. Many other countries have not yet concluded international investment agreements with China. This is not conducive to balancing and protecting the interests of the host country and investors. Since the implementation of the Belt and Road Initiative, China has actively promoted the upgrading of international investment agreements, and has made some important progress.Many important sustainable development oriented new generation international investment agreements have been negotiated and concluded. However, the proportion of the new generation of balanced international investment agreements is still small, and China still needs to continue to actively promote the upgrading of old international investment agreements. In addition, China's new generation of international investment agreements still need to be further upgraded. For example,substantive provisions such as fair and equitable treatment and most favored nation treatment need to be further improved, and the dimension of sustainable development needs to be further strengthened. Furthermore, China should actively explore the international investment agreement paradigm that fits the Belt and Road Initiative and reflects China's successful experience in development and modernization.
