摘要
自我优待是国内外数字经济反垄断执法中提出的新概念,妥善处理数字平台自我优待行为的反垄断法规制问题,有利于促进我国数字经济的健康发展。数字平台自我优待行为体现了滥用市场力量排除限制竞争的垄断本质,应适用滥用市场支配地位条款进行规制。针对相关市场界定、市场支配地位认定和规制路径选择中面临的挑战和困难,为有效规制数字平台自我优待行为,应当改进平台经济场景下相关市场界定方法,重构滥用市场支配地位的多维分析架构,构建以差别待遇为主体的综合性规制路径体系。
Self-preferential treatment is a new concept put forward in the anti-monopoly law enforcement of digital economy at home and abroad.Proper handling of the anti-monopoly regulation of self-preferential treatment of digital platforms is conducive to the healthy development of China's digital economy.The self-preferential treatment behavior of digital platforms reflects the monopolistic na-ture of abusing market power to exclude and restrict competition,and should be regulated by applying the provisions on the abuse of mar-ket dominance.In order to effectively regulate self-preferential treatment behavior on digital platforms,it is necessary to improve the meth-ods for defining relevant markets in the platform economy scenario,reconstruct a multidimensional analysis framework for the abuse of mar-ket dominance,and establish a comprehensive regulatory path system primarily based on differential treatment.
