摘要 食品安全成为国家重点关注的民生问题,食品安全监督抽检是保障食品安全的重要举措。在实施食品安全战略的时代背景下,本文重点分析国家出台的相关规章制度和行政法规,提出了食品抽检应遵循的行政法规和抽检程序规范。从规章制度、指标设定、适用范围、权力责任和程序规范等方面阐述了如何对食品安全监督抽检的合法性控制。根据科学、合理的食品安全国家标准,从设定指标、卫生要求、适用范围、检验方法等维度出发,提出了食品安全监督抽检的合法性控制规范。 Food safety has become a key concern of people’s livelihood,and food safety supervision and sampling inspection is an important measure to ensure food safety.Under the background of the implementation of food safety strategy,this paper focuses on the analysis of relevant rules and administrative regulations issued by the state,and puts forward the administrative regulations and sampling procedure norms that should be followed in food sampling.This paper expounds the legal control of food safety supervision and sampling inspection in the aspects of rules and regulations,index setting,scope of application,power and responsibility,and procedural norms.According to the scientific and reasonable national food safety standards,this paper briefl y describes the legal control norms of food safety supervision and sampling inspection from the dimensions such as setting indicators,hygiene requirements,scope of application,and inspection methods.
