摘要
本文从我国与蒙古国石油、天然气领域标准化管理模式及法律体系出发,重点梳理我国与蒙古国标准化管理模式以及二者之间的差异,梳理我国与蒙古国有关石油和天然气方面的规定,比较两国有关石油和天然气的含义,管理体系,勘查、开采矿产资源的主体及方式,勘查、开采矿产资源的程序,申请开采石油、天然气许可证的材料和矿权类型等六个方面的法律规定,分析二国法律法规之间规定的差异点。从而得出中蒙两国石油天然气的标准化管理体制间的差异以及政府干预的风险、环保合规风险、合同被解除风险和劳务用工风险四个方面的法律风险以及相应的防范措施,为项目顺利开展奠定良好的法律基础。
Starting from the standardization management mode and legal system of China and Mongolia in the fi eld of petroleum and natural gas,this paper focuses on the standardization management mode of China and Mongolia and the differences between them,sorts out China’s and Mongolia’s relevant regulations on petroleum and natural gas.The paper compares the legal provisions of six aspects in China and Mongolia,including the meaning of petroleum and natural gas,management system,subject and method of exploration and exploitation of mineral resources,procedure of exploration and exploitation of mineral resources,materials for application for exploitation of petroleum and natural gas licenses,and types of mining rights,to analyzes the differences of the laws and regulations between China and Mongolia.Therefore,the paper concludes the differences in standardization management systems of petroleum and natural gas between China and Mongolia,the legal risks of four aspects,including government intervention,environmental compliance,contract cancellation and labor employment,as well as corresponding preventive measures,which lays a good legal foundation to carry out projects smoothly.
