摘要
土地利用变化是造成生物多样性丧失的主要因素之一。现有理论和实践已充分表明优化土地利用是保护生物多样性的重要手段,且优化土地利用对维护生态环境稳定性和整体性的追求,使得保护生物多样性成为其重要目标。目前,通过优化土地利用保护生物多样性已在立法及项目实施中有所体现。当前法学层面探寻通过优化土地利用保护生物多样性应从以下几个方面展开:一是土地利用规划中生物多样性保护的理念、目标强调及内容融入;二是土地利用管理中生物多样性保护的法律制度革新;三是土地利用监督中生物多样性保护的主体整合与拓宽;四是土地利用能力与水平提升中对生物多样性保护相关因素的考量。
Changes in land use is one of the main factors causing the loss of biodiversity.Existing theories and practices have fully demonstrated that the optimization of land use is an important means to protect biodiversity,and the pursuit of optimizing land use to maintain the stability and wholeness of the ecological environment makes the protection of biodiversity an important goal of optimizing land use.Biodiversity conservation through land use optimization is now reflected in legislation and project implementation.At present,the exploration of biodiversity conservation through optimization of land use should be carried out in the following aspects:the emphasis on concept and objective,with integration of biodiversity conservation in land-use planning;the innovation in legal system for biodiversity conservation in land-use management;the integration and broadening of the subject of biodiversity conservation in land use supervision,and the consideration of factors related to biodiversity conservation in the enhancement of land-use capacity and capability.
