摘要
数字经济时代,消费者个人数据隐私日益关乎消费者切身权益,同时是平台重要的战略资源和竞争要素。实践中,平台为追求利益实施不当收集、利用数据的行为,可能构成数据驱动型经营者集中、滥用市场支配地位等不当竞争行为。同时,消费者数据隐私保护存在反垄断立法宗旨未包含消费者数据隐私保护、数据隐私难以量化、数据隐私保护部门法益冲突等困境。为解决上述困难,在反垄断立法与法律解释中延伸消费者福祉含义、发展替代性数据隐私分析工具、完善反垄断法执法部门同其他部门的合作机制,共同防范消费者数据隐私滥用风险。
In the era of digital economy,the privacy of consumers'personal data is increasingly related to the personal rights and interests of consumers,and it is also an important strategic resource and competitive element of the platform.In practice,the behavior of improper collection and use of data in pursuit of interests may constitute improper competition behaviors such as data-driven operator concentration and abuse of dominant market position.At the same time,the protection of consumer data privacy has the purpose of anti-monopoly legislation does not include consumer data privacy protection,data privacy is difficult to quantify,and the conflict of legal interests of data privacy protection departments.In order to solve the above difficulties,the meaning of consumer well-being is extended in the anti-monopoly legislation and legal interpretation,alternative data privacy analysis tools are developed,and the cooperation mechanism between the anti-monopoly law enforcement departments and other departments is improved,so as to jointly prevent the risk of consumer data privacy abuse.
