摘要
自媒体传播根本地改变了传统的传播格局,使个体获得了最大限度的表达自由。然而,当人们为实现表达自由与传播平等欢呼之时,隐私侵权问题也从传统的物理空间悄然延伸到网络空间中,并越来越呈现出一种无所不在、防不胜防的隐私际遇。自媒体传播带来的隐私问题,需要在媒介技术与隐私观念变迁的展开中进行理解,在剖析自媒体传播中隐私保护的内生困境中寻求破解之道,在此基础上结合互联网媒介技术的特殊性进行法律规制的重构。
We-media communication has fundamentally changed the traditional communication pattern,and made individuals obtain the maximum freedom of expression.Howeverwhen people cheer for the realization of freedom of expression and equality of communication,the problem of privacy infringement also quietly extends from the traditional physical space to the network space,and increasingly presents an omnipresent and unpreventable privacy encounter.The privacy problems brought by we media communication need to be understood in the development of media technology and privacy concept changes,and sought to solve in the analysis of the endogenous dilemma of privacy protection in we-media communication.On this basis,the legal regulation is reconstructed combined with the particularity of Internet media technology.
