摘要 人工智能技术的发展,带来了生产力的巨大变革。在司法领域,依托人工智能技术发展起来的智慧司法在解放司法生产力,提高审判质效等方面已经展现出巨大潜力。作为人工智能核心的算法技术,很大程度上决定着智慧司法的决策效果。因此,在目前的司法实践中,智慧司法系统的开发与推广,使算法技术在司法过程中占据越来越重要的地位。应当清楚地认识到,数据质量瑕疵、算法黑箱以及算法依赖等问题在一定程度上影响着司法的公正与权威。为此,可以从算法的数据质量的提升、算法解释机制的建设、技术边界的把握以及综合人才的培养等方面进行规制,极力降低算法技术给司法活动带来的风险,保证智慧司法在公平正义的轨道上有序推进。在相关政策的支持下,我国智慧司法建设已经迈上了快车道,成为新时代中国特色社会主义法治建设的重要环节。 The development of artificial intelligence technology has brought about great changes in productivity.In the judicial field,intelligent justice developed by artificial intelligence technology has shown great potential in liberating judicial productivity and improving trial quality and efficiency.As the core of artificial intelligence,algorithm technology largely determines the decision-making effect of intelligent justice.In the current judicial practice,the development and promotion of intelligent judicial system makes the algorithm technology occupy an increasingly important position in the judicial process.It should be clearly recognized that problems such as data quality defects,algorithmic black boxes and algorithmic dependence affect the justice and authority of the judiciary to some extent.To this end,regulations can be carried out from the aspects of improving the data quality of the algorithm,constructing the algorithm interpretation mechanism,grasp the technical boundary and training comprehensive talents,to minimize the risks brought by algorithm technology to judicial activities and ensure the orderly progress of intelligent justice on the track of fairness and justice.With the support of relevant policies,the construction of intelligent judiciary in China has stepped on a fast track and become an important link in the construction of socialist rule of law with Chinese characteristics in the new era.
