摘要
随着数据资源利用广度和深度的持续拓展,由此引发的伦理问题愈发凸显。数据交易中的伦理问题可以从安全伦理、自由伦理、利益伦理三个维度展开。其中安全伦理,即个人信息权利问题具有典型性和核心性,主要指数据交易中个人信息的安全,主要表现在个人信息的非法收集、个人信息的泄露两方面;数据交易中的自由伦理是指各主体能够自由利用数据,包括交易双方能够依照意思自治原则进行交易,也包括数据主体能够享有个人信息自决权;数据利益伦理的核心则是正确调节数据交易中各主体利益与社会整体利益的关系。为解决数据交易中数据伦理的失序,应由数据交易平台建立数据交易中的数据伦理审查机制,对数据交易中的数据安全伦理、数据自由伦理进行全面监管,同时通过明确数据权属解决数据利益伦理问题,推动公益诉讼以实现数据伦理的司法救济。
With the continuous expansion of the breadth and depth of the use of data resources,the resulting ethical problems become more and more prominent.The ethical issues in data transaction can be carried out from three dimensions:security ethics,freedom ethics and interest ethics.Among them,security ethics,that is,the issue of personal information rights as typical and core,mainly refers to the security of personal information in data transactions,largely expressed in two aspects:illegal collection of personal information and disclosure of personal information.Free ethics in data transactions means that subjects can use data freely,including that both parties can trade in accordance with the principle of autonomy of will,and that data subjects are entitled to the right to self-determination of personal information.The core of data interest ethics is to correctly adjust the relationship in data transactions between the interests of each subject and the whole interests of society.In order to solve the disorder of data ethics in data transactions,the data ethics review mechanism in data transactions should be established by the data transaction platform,and the data security ethics and data freedom ethics in data transactions should be comprehensively supervised.At the same time,the ethical problems of data interests can be solved by defining the ownership of data,and public interest litigation can be promoted to realize the judicial relief of data ethics.
