摘要
网络直播是随着互联网技术高速发展应运而生的新兴产业,由于法律法规滞后、行业规范不完善、平台监管不力、技术创新不足以及主播知识产权法治素养较差,网络直播井喷式发展的同时带来了知识产权风险,包括著作权侵权、商标侵权、专利侵权等。由于网络直播对于刺激消费、优化电商结构、创新销售服务形态以及赋能供应链具有重要作用,因此需要从法律层面、行业层面、平台层面、技术层面和主播层面对网络直播知识产权风险进行多元化治理,从而使网络直播行业得到长远健康发展。
Network broadcast is an emerging industry arising from the rapid development of Internet technology,due to lagging laws and regulations,imperfect industry norms,ineffective platform supervision,insufficient technological innovation and poor legal literacy of anchors on intellectual property rights,the blowout development of network broadcast also brings intellectual property risks,including copyright infringement,trademark infringement,patent infringement and so on.Network broadcast plays an important role in stimulating consumption,optimizing the structure of e-commerce,innovating the form of sales and service and empowering the supply chain,therefore,it is necessary to conduct diversified management on the intellectual property risks of network broadcast from the legal,industrial,platform,technical and anchor levels,so as to achieve long-term and healthy development of the network broadcast industry.
