摘要 在过去的30年里,互联网的成功造就了众多新的服务,并大幅增加了消费者福利,也为企业创造了许多新的机遇。然而,种种担忧亦接踵而至,即一些大型数字公司及其使用的算法可能获得过多的影响力。全球各国通过各种法律来解决这些问题。通过反垄断法和监管法对潜在的竞争作出回应。在德国,立法者曾两次(2017年和2021年)修订《反限制竞争法》(GWB),以更好地涵盖数字市场和商业模式。对此,当时的重点是改进对权力滥用的监督。在欧盟,立法者选择通过《数字市场法》(DMA)对数字守门人进行监管,该法案自2023年5月2日起生效,并提列了众多禁止条款。本文将德国的法规(特别是《反限制竞争法》第19a条)与《数字市场法》进行比较,并批判性地对这两部法规进行评估。 The triumph of the internet over the past 30 years has enabled numerous new services and brought significant benefits to consumer welfare.It has also created many new opportunities for businesses.However,concerns have arisen that some major digital companies and the algorithms they use could gain too much influence.These issues are being addressed worldwide through various laws.Potential competition problems are being tackled through antitrust and regulatory law.In Germany,the legislature revised the Act Against Restraints of Competition(GWB)twice(in 2017 and 2021)to better address digital markets and business models,with a focus on improved abuse control.At the European Union level,the legislature has opted for the regulation of digital gatekeepers through the Digital Markets Act(DMA),which has been in effect since May 2,2023,and sets out numerous prohibitions.This article compares the German regulations,especially§19a of the GWB,with the DMA and critically evaluates both regulations.
