摘要
大数据时代的来临使得数据在经营活动和市场竞争中的价值日益凸显,数字企业已然认识到数据重要的商业价值,数据驱动型经营者集中的产生和发展有其时代必然性。现有反垄断框架下,经营者集中审查标准存在局限性、相关市场界定的传统框架适用困难、竞争效果分析受到干扰等问题,使得数据驱动型经营者集中的反垄断法规制无法适应现实需要。为此,应当通过改善经营者集中申报标准、优化数据密集型行业相关市场界定的方法以及重视竞争效果评估中的非价格因素等手段,加强对数据驱动型经营者集中规制规范。
With the advent of the era of big data,the value of data in business activities and market competition has become increasingly prominent.Digital enterprises have realized the important commercial value of data,and the emergence and development of data-driven concentration of undertakings has its inevitability.Under the existing anti-monopoly framework,the limitations of the standards for centralized examination of operators,the difficulty in applying the traditional framework for defining relevant markets,and the interference in the analysis of competition effects make the anti-monopoly regulation of data-driven concentration of undertakings unable to meet the actual needs.Legislation and law enforcement departments should strengthen the improvement of the problem of insufficient centralized regulation of data-driven concentration of undertakings by improving the standards for centralized declaration of operators,optimizing the methods for defining relevant markets in data-driven industries,and paying attention to non-price factors in the evaluation of competition effects.
