摘要
行政法是一个历史现象,行政法典制定既要以一定的历史积淀为基础,又要有新的超越。中国行政法蕴含着注重历史传承、行政法开放性、目标意识和问题应对、权威主导、实用理性、程序和实体和谐、行政法治中人民性等优良基因。传承优良基因有助于行政法典形成中国特色的概念系统和典则模式。在立法技术上,行政法优良基因入典要处理好本土资源与域外资源、行政法文化与行政法制度、行政法既有内容与行政法典中新内容、行政法中硬法与软法等诸种关系。
Administrative law is a historical phenomenon,and the formulation of administrative code should not only be based on certain historical accumulation,but also have new transcendence.China's administrative law contains some excellent genes,such as focusing on historical inheritance,openness of administrative law,goal consciousness and problem response,authority leading,practical rationality,harmony of procedure and entity,people's character in administrative rule of law,and so on.The inheritance of these fine genes is helpful for the administrative code to form a conceptual system and canonical model with Chinese characteristics.In terms of legislation technology,the introduction of excellent genes in administrative law should properly deal with the relationship between local resources and extraterritorial resources,administrative law culture and administrative law system,the existing content of administrative law and the new content of administrative code,hard law and soft law in administrative law.
