摘要
“人类命运共同体”理念是习近平新时代中国特色社会主义思想的重要组成部分。在全面分析、认真总结在全球系统性风险增加、国际社会不稳定因素增强的百年未有之大变局的背景下,其核心是将当前国际关系的发展趋势总结为世界各国既有挑战又高度融合的“休戚与共”的新型合作伙伴关系。“人类命运共同体”理念蕴含着价值目标的先进性,能够引领国际法治变革。在全球化日益加速的特定时空条件下,习近平法治思想中的国际法治观念应运而生,可以为国际法治变革突破“以规则为基础”的秩序困局提供价值指引。“人类命运共同体”理念逻辑严密、内涵丰富、系统完备,充分彰显了时代特征,体现了国际社会共同利益价值取向,为应对人类社会面临的共同挑战做出了原创性贡献,为构建新型国际关系基本准则奠定了理论基础。促进世界和平与发展,推动构建“人类命运共同体”被明确写入党的二十大报告中,其发挥作用的重要途径就是要从理念向法律规则转型。深入研究国际法规则产生、发展的一般规律,最终为理念向国际法规则转型提供路径指引,对新时期构建合作共赢的新型国际关系具有里程碑式的意义。
In the context of increasing global systemic risks and the strengthening of international stability,the current trend of international relations is summarized as a new type of partnership in which all countries in the world are both challenging and highly integrated.The concept of“a community with shared future for mankind”is the starting point and destination of Xi Jinping Thought on the Rule of Law,and the concept of international rule of law in Xi Jinping Thought on the Rule of Law has emerged under the specific conditions of accelerated globalization.The core contents include national sovereignty,national security,national interests,international system,international peace,international cooperation,global governance and comprehensive development.The concept of“a community with shared future for mankind”is logical,rich in connotation,systematic and complete,fully manifests the characteristics of the times,reflects the value of the common interests of the international community,makes an original contribution to addressing the common challenges faced by human society,and lays the theoretical foundation for the construction of the basic norms of a new type of international relations.The important way to play its role is to transform from ideas to legal rules,to study in depth the general rules of the emergence and development of the rules of international law,and finally to provide path guidance for the transformation of ideas to the rules of international law,which is important for the new era.It is of milestone significance to build a new type of international relations of cooperation and win-win situation.
