摘要
营商环境是影响民营企业成长与发展的外生性因素。推进营商环境法治化,应顺应民营企业尤其是民营中小企业的生存发展现状与需求;应设定特定的测度指标,以更好地彰显营商环境法治化对民营企业发展的作用机理与实际效果;应构建适应民营企业发展的针对性的制度体系,以更好地发挥营商环境法治化对民营企业发展的促进与保障作用;结合我国国情,在推动营商环境法治化过程中,应通过地方立法互动以达到精准推进的实际功效。
The business environment has a significant impact on the development of private enterprises.The development status and needs of private enterprises should be taken into consideration so as to promote the rule of law for business environment,especially for small and medium-sized enterprises.Specific measurement indicators should be set to better demonstrate the impact mechanism and actual effect of the legalization of the business environment on the development of private enterprises.And a specific institutional framework should be built to adapt to the development of private enterprises to better leverage the legalization of business environment in promoting and safeguarding the development of private enterprises.During the process of promoting the rule of law for the business environment,local legislative interaction should be used to achieve the effect of precise advancement by considering the national conditions and context of China.
