摘要
数据共享在智能汽车领域的重要价值尤为凸显,能够提升智能汽车行业的整体安全和效率,成为智能汽车大规模商业化落地亟待解决的前提问题。当前产业实践中智能汽车数据并未实现有效融合,数据孤岛普遍存在,面临的困境主要表现为数据共享的基本规则缺乏、共享主体的激励机制缺失以及数据安全风险隐患。对此我国应当建构智能汽车数据共享的法律制度体系,确立数据共享的基本原则,围绕“共享前提—共享什么—与谁共享—如何共享”的链条而构建可操作性的共享规则,形成数据权益配置、共享获利、成本分担等数据共享的激励机制,加强用户个人信息、企业商业秘密以及国家安全利益的保护,设定智能汽车数据共享的合理限度。
The important value of data sharing in the field of intelligent vehicles is particularly prominent,which can improve the overall safety and efficiency of the intelligent vehicle industry,and become a prerequisite problem to be solved for the large-scale commercialization of intelligent vehicles.In the current industrial practice,the data of intelligent vehicles has not been effectively integrated,and data silos are widespread.The legal dilemma faced is mainly manifested in the lack of basic rules for data sharing,low subjective willingness of the sharing subjects and hidden risks of data security.In this regard,China should build a legal system of intelligent vehicle data sharing,which establishes the basic principles of data sharing,constructs operable sharing rules around the chain of“sharing premises-what to share-with whom to share-how to share”,forms an incentive mechanism for data sharing such as data rights allocation,sharing profit,and cost sharing,strengthens the protection of user personal information,business secrets and national security interests,and sets a reasonable limit for intelligent car data sharing.
