摘要
叙事贯穿庭审始终。控辩律师作为庭审中最为重要的叙事者,对于同一案件的事实进行差异化的叙事,由此形成叙事对抗。这种叙事对抗可以通过语篇语义层面的概念系统和词汇语法层面的及物性系统的选择得以实现。本文以普通法系下弗洛伊德案为例,采用定量和定性相结合的研究方法分析庭审中控辩律师的结辩陈词,旨在从系统功能语言学和叙事学视角探究控辩律师在同一案件中如何围绕双方当事人及其行为运用或操控概念意义以展开叙事对抗。研究结果发现,控辩律师通过策略性地选择词汇语法和语篇语义资源对当事人及其行为进行叙述,表达不同的概念意义,建构不同的叙事世界,最终形成叙事对抗。本研究在系统功能语言学视阈下分析法律叙事,有助于律师从语言学视角全面理解控辩过程中的叙事对抗,提升律师在庭审中的话语能力,最终促进司法公平正义的实现。
Narration permeates throughout the court proceedings.The prosecution and defense attorneys,serving as primary narrators in the trial,construct differentiated narratives of the same case,leading to narrative contestation.This contestation can be achieved by selecting options from the ideation system at the level of discourse-semantics and the transitivity system at the level of lexico-grammar.This paper adopts a combination of quantitative and qualitative research methods to analyze the closing arguments of the prosecution and defense attorneys in the murder case of George Floyd and aims to investigate how the prosecution and defense attorneys engage in narrative contestation around the two parties and their behavior in the same case from the perspective of systemic-functional linguistics and narratology.The findings show that the prosecution and defense attorneys,by strategically choosing lexical-grammatical and discourse semantic resources to realize competing ideational meanings,construct divergent narrative worlds,and ultimately form narrative contestation.Through the lens of systemic-functional linguistics,this study analyzes legal narratives and may contribute to a comprehensive understanding of narrative contestation during the prosecution and defense processes,while also potentially enhancing the attorneys'linguistic capabilities during the trial and promoting the realization of judicial fairness and justice.
