摘要
通过婚姻制度的不断革新以争取婚姻自由、实现妇女解放之目的,是新民主主义革命时期和社会主义改造时期中国共产党领导的法律革命的重要主题。中国共产党成立之初,由于缺乏实践条件,主要从党内法规层面完成了对婚姻自由之于妇女解放运动的认识和相应的立规,为后续具体的法律实践奠定了理论基础。经过土地革命战争时期、抗日战争时期和解放战争时期的一系列曲折前进的立法与司法层面的法律实践,中国共产党逐渐形成了以婚姻自由、男女权利平等为核心内容的婚姻制度建设经验。中华人民共和国成立后,为了彻底废除封建婚姻制度,重构社会秩序,中国共产党在吸取历史教训、整理实践经验的基础上,通过《婚姻法》的颁行和贯彻,完成了新民主主义婚姻制度在全国范围内的推行,在婚姻家庭领域初步实现了妇女解放,基本践行了党的婚姻观,为中国特色社会主义妇女解放事业发展道路的推进奠定了坚实的理论与实践基础。这些经验对新时代两性关系的发展仍具有重大的现实指导意义。
To strive for the freedom of marriage and realize the liberation of women through the continuous innovation of the marriage system is an important theme in the legal practice led by the CPC during the New Democratic Revolution.At the beginning of the founding of the Communist party of China,due to the lack of practical conditions,the Party mainly completed the understanding of marriage for women’s liberation movement and corresponding regulations from the level of intraparty laws and regulations,laying a theoretical foundation for subsequent specific legal practice.After a series of twists and turns in legislation and the judicial legal practice during the Agrarian Revolution,the Anti-Japanese War and the War of Liberation,the CPC has gained experience of marriage system construction with the freedom of marriage and equal rights of men and women as the core content.After the founding of the PRC,in order to abolish the feudal marriage system and rebuild social order,the Party,with historical lessons and practical experience,completed the nationwide implementation of the new democratic marriage system through the promulgation and implementation of the Marriage Law,and initially achieved the liberation of women in marriage and family and the party’s concept of marriage.This has laid a solid theoretical and practical foundation for advancing the development of the liberation cause of women with Chinese characteristics.These experiences still have strong practical significance for the development of gender relations in the new era.
