论司法机关在家庭教育工作联动机制中的作用——对于《家庭教育促进法》第8条的规范解释

摘要 《家庭教育促进法》第8条明确规定司法机关应配合同级人民政府及其有关部门建立家庭教育工作联动机制,共同做好家庭教育工作。依据这里关于司法机关的定位,司法机关在家庭教育工作联动机制中承担辅助权能,发挥资源互通、工作互促、特殊保护等重要作用。但是由于《家庭教育促进法》的规定较为原则,在整体性制度设计、具体操作性规则和责任体系方面存在进一步完善的空间。为充分发挥司法机关的职能作用,应以司法权整合家庭教育资源,强化司法机关与相关部门、组织的协同,明晰相关主体的法律责任,建立专业化、制度化、规范化的家庭教育工作联动机制。 Article 8 of the Family Education Promotion Law clearly stipulates that the judicial organs should cooperate with the people’s government and its relevant departments at the same level to establish a linkage mechanism for family education work and together do good work for family education.According to the positioning of the judicial organs as described in Article 8,the judicial organs assume the auxiliary power in the linkage mechanism of family education work,and play an important role in resource sharing,mutual promotion of work,and special protection.However,due to the relatively principled provisions of the Family Education Promotion Law,there is room for further improvement in the overall system design,specific operational rules and responsibility system.In order to give full play to the functions and roles of judicial organs,judicial power should be used to integrate family education resources,strengthen coordination between judicial organs and relevant departments and organizations,clarify the legal responsibilities of relevant entities,and establish professional,institutionalized,and standardized linkage mechanisms for family education work.
