摘要
党政联合发文信息公开的司法审查以审查制发主体的形式审查规则为主。该模式容易加重信息需求与供给间的矛盾,模糊行政机关公开义务,无法满足相关诉讼需求。司法审查的规范化需引入实质审查规则,先对文件定性,再查明相应的公开规则,且法院可通过向行政机关及党的机关提出公开联合发文的司法建议,填补司法裁判之局限性。
The judicial review of information disclosure jointly issued by party and government is mainly based on the review rules in the form of reviewing the production and distribution subject.This mode easily exacerbates the contradiction between supply and demand information,obscure the disclosure obligation of administrative organs,and cannot meet relevant litigation needs.The standardization of judicial review requires the introduction of substantive review rules,which first characterize documents and then identify corresponding disclosure rules.And the court can fill in the limitations of judicial decisions by making public joint judicial recommendations to administrative and party agencies.
