摘要
数据法学教学改革的本质在于回应大数据赋能法学教学的变迁。数据的功能已超越传统的信息载体,扩展到逻辑理念乃至跨学科融合的新范式。大数据技术推动着社会变革,法学教育领域也面临着变迁的压力。针对法学教育与大数据融合中呈现的“法律与技术差异化”“思维与实践差异化”“决策与成果差异化”等困境,新法学建设提供了理念革新的思路。在数据科学与法学相互建构、相互影响的进程中,新法学视域下的数据法学教学改革,需要采取法律衔接技术、课堂回应社会、传统与现代理念融合的跨学科协同策略,促进“大数据+法学”生态的良性互动,推动我国大数据时代的法学教学改革与实践创新。
The nature of data law teaching reform is to respond to the changes in law teaching brought by big data.More than functioning as the traditional information carrier,data has expanded to the system of logical concepts and even the new paradigm of interdisciplinary integration.Big data technology is promoting social transformation,in which law education is also facing the pressure of change.Aiming at the dilemma produced by the"differentiations between law and technol⁃ogy,thinking and practice,decision and outcome"in the integration of data into law education,the construction of new law provides a way out by innovating the teaching concepts.In the process of mutual construction and mutual influence be⁃tween data science and law science,data law teaching reform is demanded to take an interdisciplinary collaborative ap⁃proach by integrating law and technology,university and society,traditional ideas and modern concepts,so that the new paradigm of"big data plus law"can result in a positive interaction and promote China's law teaching reform and practice in the big data era.
