摘要
制定《对外关系法》是对外关系领域贯彻习近平新时代中国特色社会主义思想、坚持统筹推进国内法治和涉外法治、提高对外工作法治化水平的重要成果,也是立法领域加快涉外法治工作战略布局,完善涉外法律体系,增强涉外立法的系统性、整体性、协同性和时效性的重大进展。该法具有鲜明的中国特色和时代特征,既从宏观层面进行顶层设计,形成对外关系法律体系“一体两翼”的基本格局,也从微观层面构筑起“四梁八柱”的法律支撑;既充分体现坚持中国特色社会主义道路的一以贯之,又充满以法治思维和法治方式有效应对风险挑战的与时俱进,守正固本、创新发展的意涵浓郁,堪称中国对外关系立法的系统集成之作和守正创新之作,在涉外法治建设史上具有里程碑意义。
The enactment of the Law on Foreign Relations of the People's Republic of China,the first fundamental and comprehensive foreign relations law,is a significant achievement in implementing Xi Jinping Thought on Socialism with Chinese Characteristics in the New Era in the field of foreign affairs,which insists on promoting the domestic rule of law and foreign-related rule of law in a coordinated manner,and enhances the level of the rule of law in external affairs.It is also a great progress in speeding up the strategic layout of foreign-related legislation,improving the foreign-related legal system,and enhancing the systematization,integrity,coordination and timeliness of foreign-related legislation.This law has distinct Chinese characteristics and the features of the times,forming a basic legal framework of“one system with two wings”from the macro-level design,and building a supporting system with“four beams and eight pillars”from the micro-level.It not only fully embodies the consistency of adhering to the path of socialism with Chinese characteristics,but also is full of the significance of keeping pace with the times,maintaining the solid foundation and innovative development by effectively responding to risks and challenges with the rule of law thinking and the way of the rule of law.It can be regarded as the systematic integration and inheritance and innovation work of China's foreign relations legislation.And it is indeed a milestone in the history of China's legislation concerning foreign-related affairs.
