摘要
虚假流量对互联网时代的经营者具有极大的商业诱惑性。基于获益模式的差异,虚假流量行为可以分为刷单获益型和指标获益型两种典型形式。司法实践中如何规制虚假流量行为不仅面临不同请求权基础的抉择,也将直面如何适用互联网专条的现实挑战。规制虚假流量行为的要点包括:一是要基于获益模式的差异对虚假流量行为进行分类规制;二是适用互联网专条对虚假流量行为进行规制时要对“利用技术手段”进行扩大解释,并适当降低其证明标准;三是应充分考虑互联网行业的特性,在司法实践中对商业惯例进行适当引入以保持规制与创新之间的某种平衡;四是对虚假流量行为进行规制时要对消费者利益的反射性保护抱有充分的认识。
False traffic has great commercial allure to the operators in the Internet age.False traffic behavior of billing benefit and false traffic behavior of indicator benefit are important classifications of this behavior.How to regulate false traffic behavior in judicial practice not only needs to face the choice of different claim bases,but also faces the practical challenge of how to apply Internet clause.The main points of regulating false traffic behaviors include:first,classifying and regulating false traffic behaviors based on the difference of profit patterns;secondly,when applying Internet clause to regulate false traffic behavior,it is necessary to expand the explanation of“using technical means”and appropriately lower its standard of proof;thirdly,we should fully consider the characteristics of the Internet industry,and properly introduce business practices in judicial practice to maintain a certain balance between regulation and innovation;fourthly,when regulating false traffic behavior,we should pay attention to the protection of consumers'interests,and consider the particularity of this protection.
