摘要
“饭制”短视频在各社交平台的崛起,为社会经济和文化繁荣贡献了突出力量,但同时也带来了严峻的版权问题,并引发了“在先作品著作权人、平台流量、版权保护”之间的利益冲突。新《著作权法》将视听作品纳入版权保护范畴并加强侵权惩治力度,解决了部分“饭制”短视频的侵权问题,但其复杂的版权困境和利益冲突依旧存在。本文旨在借鉴社会治理思路,通过平衡多方主体利益,推动“饭制”短视频的版权治理,促进视听产业高质量发展。
In the era of fan economy,the rise of short videos of fans’making on various platforms contributed to the prosperity of social economy and culture,but at the same time,it brings severe copyright problems,and causes the conflict of interest among“copyright owners of prior works,platform traffic and copyright protection”.The new Copyright Law has brought audio-visual works into the category of copyright protection and strengthened the punishment of infringement,which has solved some infringement problem of short videos of fans’making,but the complicated copyright dilemma and conflict of interest still exist.This paper draws lessons from the ideas of social governance,balances the interests of various subjects,and reconstructs the copyright governance system of fans’making short video,in order to promote the high-quality development of audio-visual industry.
