摘要
虽然2020年《著作权法》重构了“广播权”,明确了广播权和信息网络传播权的界限,但作为全新的业务模式,IPTV回看服务行为性质认定在学界和实务界仍存在很大争议。从学理对比分析广播权和信息网络传播权,IPTV回看服务具有远程传播、交互式传播、面向不特定多数人等信息网络传播的特征,不属于广播行为,属于信息网络传播行为。
Although the concept of"broadcasting right"was reconstructed in the Copyright Law of 2020 that provided clarification regarding the demarcation between broadcasting rights and the right of making content available to the public,the determination of the nature of IPTV viewing service behavior remains a topic of ongoing controversy within academic and practical spheres.By undertaking a theoretical comparative analysis of broadcasting rights and the right of making content available to the public,it becomes apparent that IPTV review service exhibits distinct characteristics such as remote communication,interactive communication,and information network communication,primarily targeting an indeterminate majority of users.Consequently,it can be argued that IPTV viewing service does not fall within the purview of traditional broadcasting behavior but,instead,aligns more closely with the behavior associated with information network communication.
