摘要
《广东省森林保护管理条例》实施近30年迎来了再次修订,2023年5月经广东省十四届人大常委会第三次会议审议通过。本立法修订的宗旨在于贯彻习近平生态文明思想,凸显“森林生态安全”保障基点,涵盖生态保护、生态建设和生态服务“三位一体”的意蕴。立法修订坚持与时俱进和守正创新的方针,体例体现行业立法的综合性与基准性;其坚持问题导向,固化成熟经验,针对广东森林保护发展突出问题进行精准规制,即以需求为牵引,破解矛盾难题,将林地、生态公益林、古树名木的保护管理整合一体化规制;同时,系统创制注意协调衔接相关立法及统筹改革发展举措,推动配套规制完善,切实增强立法的针对性、适用性、可操作性,从而强化了统筹推进广东森林保护发展暨绿美广东生态建设的法治基础。
The"Regulations on the Protection and Management of Forests in Guangdong Province"have been revised again in the past 30 years of implementation.In May 2023,it was reviewed and approved at the third meeting of the 14th Standing Committee of the Guangdong Provincial People's Congress.The legislative revision adheres to the principle of keeping up with the times and adhering to the principles of integrity and innovation,and the style reflects the comprehensiveness and benchmark of industry legislation;It adheres to a problem oriented approach,solidifies mature experience,and conducts precise regulations for prominent issues in the development of forest protection in Guangdong.It takes demand as the driving force,solves contradictions and difficulties,and integrates the protection and management of forest land,ecological public welfare forests,and ancient and famous trees into an integrated regulation;At the same time,the system creation pays attention to coordinating and connecting relevant legislation and coordinating reform and development measures,promoting the improvement of supporting regulations,effectively enhancing the pertinence,applicability,and operability of legislation,thereby strengthening the legal foundation for promoting the coordinated development of forest protection and green and beautiful ecological construction in Guangdong.
