摘要
《嶽麓書院藏秦簡(柒)》在涉及秦漢時期轉運囚犯的法律規定中兩次出現“闌散”一詞,該詞亦見於睡虎地秦簡。整理者對“闌散”一詞没有做出解釋。筆者認爲“闌散”在簡文中應讀爲“欄栅”,也即“栅欄”。簡文中的“欄栅”是指用於暫時關押囚犯的圍欄。典籍記載秦漢時期監獄周圍常常會設置欄栅,這與簡文的記載正合。
In the Qin Bamboo Slips in the Collection of Yuelu Academy(Vol.7),the word lansan(闌散)appeared twice in the legal provisions concerning the committal of prisoners during the Qin and Han dynasties,which can also be found in Shuihudi Qin bamboo slips.The collators did not interpret this word.We hold that lansan here could be read as lanshan(欄栅),viz.zhalan(栅欄),referring to bars behind which prisoners are temporarily confined.The ancient classics record that bars were ordinarily erected around jail in the Qin and Han dynasties,exactly tallying with the bamboo slips texts.
