摘要
在新行政处罚法制度的催化下,各省市交警开始探索交通违法行为处罚的模式创新。2021年浙江省Z市交警打造的“警斗云—数治警务平台”,再造交警执法流程,为交通违法行为处罚提供全新方法,实现执法全程留痕、执法效能提升、执法社会效应提高,破解了传统执法模式的难题,在Z市交通管理工作中发挥了重要作用。但该模式仍处于探索与磨合阶段,在实践中仍面临诸多挑战,因此在创新过程中需以行政处罚法为遵循,在法律层面进一步明确合法性,在制度层面加强规范性,在技术层面提升智慧性,为实现交通管理能力现代化贡献力量。
Under the catalytic system of the new"Administrative Punishment Law",the provincial and municipal traffic police began to explore the mode innovation of traffic illegal punishment.In 2021,the"Police Douyun-digital policing platform"created by the traffic police of Z City,Zhejiang Province,reconstructs the law enforcement process of the traffic police,provides a new method for the punishment of traffic violations,realizes the whole process of law enforcement,improves the efficiency of law enforcement,improves the social effect of law enforcement,breaks the problems of the traditional law enforcement model,and plays an important role in the traffic management of Z City.However,this model is still in the stage of exploration and running-in,thus,it faces many challenges in practice.Therefore,in the process of innovation,it is necessary to follow the administrative penalty law,further clarify the legitimacy at the legal level,strengthen the standardization at the institutional level,and enhance the wisdom at the technical level,so as to contribute to the modernization of traffic management capabilities.
