摘要
在后民法典时代,讨论家事程序法制定时首先应当回答它对于民法典有何意义这一基础性问题。民事程序法的重要作用在于规制公权力对私法领域的介入,公权力介入提供了实体法和程序法的连接点,它是透视家事程序法与民法典关系的重要线索。在民法典体系化上,家事程序法具有避免民法典去体系化、厘清不同性质规范边界的作用;在民法典中公权力介入的配置上,家事程序法具有厘清民法典公权力性质和创设符合民法规范目的的介入方式的意义;在公权力介入程序化上,家事程序法有以介入的功能为依据构造共有的程序要素、将公益性内化于程序以及以妥当的程序推进实体问题简便化处理的意义。
In the post-civil code era,the Family Procedure Law should answer the basic question of its significance to the implementation of the Civil Code.The important role of the Civil Procedure Law is to regulate the intervention of public power in the field of private law.The intervention of public power provides the connection between substantive law and procedural law which is a key clue to grasp the relationship between the Family Procedure Law and the Civil Code.In the systematization of the Civil Code,the Family Procedure Law can avoid the de-systematization of the Civil Code and clarify the boundaries of different kinds of norms.In terms of the allocation of intervention of public power in the Civil Code,the Family Procedure Law has the significance of clarifying the different natures of public power in the Civil Code and creating intervention modes in accord with the purpose of civil law.In terms of the procedural intervention of public power,the Family Procedure Law has the significance of constructing common procedural elements based on the function of intervention,internalizing the public welfare into procedures,and simplifying solution of substantive issues with appropriate procedures.
