摘要
党的二十大报告提出“强化对司法活动的制约监督,促进司法公正”。侦查监督与协作配合是刑事诉讼中制约监督的重要内容,从C直辖市公检侦查监督与协作配合机制的运行现状可以看出,侦查监督和协作配合力度在持续有效加强。但是,由于长期以来的侦检分离工作模式以及现行机制运行存在的不足,导致还存在观念分歧、机构设置、制度落实等问题。宜从改进监督观念、明确工作事项,优化机构建设、加强沟通协调,提升工作能力、提高监督质效,强化信息反馈、完善办案考评等方面进行改进,以推动侦查监督与协作配合机制的实质化运行。
The report of the 20th National Congress of the Communist Party of China put forward to strengthen the supervision and control of judicial activities and promote judicial justice.The coordinated investigation and supervision mechanism is an important part of restricting supervision in criminal proceedings.From the operation status of the mechanism of C municipality,it can be found that the power of coordinated investigation and supervision is continuously and effectively strengthened.However,due to the traditional separated mode and the deficiencies in the current mechanism operation,there are still problems in ideas,institutional settings,and system implementation.It is advisable to perfect the mechanism in terms of improving supervision concept,clarifying the work items,optimizing the organization construction,strengthening communication and coordination,improving work ability,enhancing the quality and efficiency of supervision,promoting information feedback,and perfecting the case handling evaluation,so as to promote the substantive operation of the coordinated investigation and supervision mechanism.
