摘要
近几年,全国发生燃气安全事故较多,已经披露的部分事故原因显示,这些安全事故的发生与燃气设施维护不到位直接相关。目前,我国燃气设施共有部分维护费用分摊没有明确法律规定,在燃气设施维护费用日益增长的情况下,燃气设施维护费用难以通过现有制度予以解决。分析我国城市居民燃气设施安全形势和维护费用处理面临的困境。我国燃气设施维护费用处理既要从法律、价格、监管体制上有所突破,也应遵照成本分摊、利益共享的市场原则,提出明确建筑区划红线内燃气设施产权归属、按照产权归属划分各利益相关方维护责任、明确界定居民燃气设施发生安全事故的赔付责任、按照权责利对等原则实施维护费用归集分摊、理清居民燃气设施维护成本与供气成本的结构性关系、明确居民燃气设施维护费用与供气价格之间的关系等政策建议。
In recent years,there have been many gas safety accidents in China.The reasons for some of the accidents that have been disclosed show that the occurrence of these safety accidents is directly related to the inadequate maintenance of gas facilities.At present,there is no clear legal regulation on the allocation of maintenance costs for the common part of gas facilities in China.With the increasing maintenance costs of gas facilities,it is difficult to solve them through existing systems.The safety situation of gas facilities for urban residents in China and the difficulties faced in handling maintenance costs are analyzed.The handling of maintenance costs for gas facilities in China should not only make breakthroughs in laws,prices,and regulatory systems,but also follow the market principles of cost allocation and benefit sharing.Policy suggestions are proposed,including clarifying the ownership of the property rights of gas facilities within the red line of building zoning,dividing the maintenance responsibilities of various stakeholders according to the ownership of property rights,clearly defining the compensation liability for safety accidents in residential gas facilities,implementing the collection and allocation of maintenance costs in accordance with the principle of equal rights,responsibilities and benefits,clarifying the structural relationship between the maintenance cost of residential gas facilities and the cost of gas supply,and clarifying the relationship between the maintenance cost of residential gas facilities and the price of gas supply.
