摘要
作为民事法律行为的著作权侵权,其判定思路是接触+实质性相似,关于作品实质性相似的判定前提是思想表达二分法,而《著作权法》所规定的侵权类型包括但不限于“改编、翻译、注释”等行为。因而在作品范围内,“内容”作为现实的存在,不应也不能被理论界所忽略。所以从解释论的视角出发,需要对“内容”做出新的解释。“思想说”与“表达说”分别认为可以将“内容”解释到自有体系内,但自身逻辑却无法趋避。笔者拟通过对“内容”周边概念的梳理,分析将“内容”安置在著作权法中的各种路径及其利弊。
As the copyright infringement under civil norms,the judgment rule is contact+substantial similarity.The premise of determining the substantial similarity of works is the dichotomy of ideological expression,and the types of infringement stipulated in the Copyright Law include but are not limited to"adaptation,translation,annotation"etc.Therefore,within the scope of works,the existence of"content"as reality should not and cannot be ignored by the theoretical circle.Therefore,from the perspective of hermeneutics,a new interpretation of"content"is needed."Thought theory"and"expression theory"respectively believe that"content"can be explained into its own system,but its own logic cannot be avoided.The author intends to analyze the various paths and advantages and disadvantages of placing"content"by sorting out the surrounding concepts of"content".
