摘要
我国检察机关技术性证据专门审查工作呈现基层检察机关承办案件数量最多却开展最少的样态。究其原因,基层检察人员缺乏开展技术性证据专门审查工作的意识、技术性证据专门审查制度的启动与实施程序不明确、基层检察机关存在资源限制等。然而,基层检察机关基于办理案件需要、加强法律监督与防控错案责任等因素,具有开展技术性证据专门审查的必要性。为落实基层检察机关技术性证据专门审查工作机制的开展,应当尽快贯彻落实刚出台的《人民检察院技术性证据专门审查工作规定》,并通过会议、讲座、相关工作提示的方式加强基层检察人员开展技术性证据专门审查工作的意识。同时需要进一步明确技术性证据专门审查制度的启动条件、合理编配技术性证据专门审查人员、设置多元的技术性证据专门审查方式。
The special review of technical evidence of procuratorial organs in China shows that the number of cases handled by grass-root procuratorial organs is the most but the review number is the least.The reasons are the lack of awareness of technical evidence review,the unclear procedure of starting and implementing the technical evidence review system,and the resource limitations of grass-root procuratorial organs.However,it is necessary for grass-root procuratorial organs to carry out special review of technical evidence based on the needs of handling cases,strengthening legal supervision and responsibility for prevention and control of misjudged cases.In order to implement the work mechanism for the special review of technical evidence for grass-root procuratorial organs,the Provisions on the Special Review of Technical Evidence of the People's Procuratorate shall be promulgated as soon as possible.And through meetings,lectures,related work tips to strengthen the grass-root prosecutors to carry out technical evidence special review work consciousness.At the same time,it is necessary to further clarify the starting conditions of the special examination system of technical evidence,rationally allocate the special examiners of technical evidence,and set up multiple special examination methods of technical evidence.
