摘要
在乡村振兴战略要求下,乡村文明建设需要高效化解家事纠纷,而家事纠纷的伦理性、隐私性和情感性等特征,决定了其更适合采用非诉方式化解,但现行非诉化解纠纷制度存在作用退化、缺乏多元协作和一体化非诉家事解纷中心及在线应用平台、非诉家事纠纷化解程序不规范、家事调解队伍“情理法”融合能力不足等问题,需要融合传统“情理法”的内涵,借鉴国内外非诉化解家事纠纷的成功经验,强化以人民调解为主的非诉化解纠纷制度的作用、多元协作、建立基层一体化非诉家事解纷中心、建设完善在线应用平台、加强家事调解员培训、提高调解员融合“情理法”的能力等非诉家事纠纷应用机制,以期为乡村振兴提供一定的助力。
Under the strategic requirements of rural revitalization,the construction of rural civilization needs to resolve family disputes effectively.Due to the ethical,private and emotional characteristics of family disputes,it is more suitable to adopt non-litigation methods to resolve them.However,there exist certain problems in the current non-litigation dispute resolution system,such as degradation of function,lacking of multiple collaboration,integrated non-litigation family dispute resolution centers and online application platforms,nonstandard family dispute resolution process,and low integration ability of“emotion and legislation”among family mediation teams.These defects require integrating the connotation of traditional“rational law”,drawing on the successful experience of non-litigation dispute resolution at home and abroad,strengthening the function of non-litigation dispute resolution systems based on people's mediation,focusing on multiple collaboration,establishing grass-roots integrated non-litigation dispute resolution centers,building and improving online application platforms,and strengthening the training of family mediators to improve their ability to integrate“rational law”and other non-litigation family disputes application mechanisms,with a prospect to provide certain assistance on rural revitalization.
