摘要
公正司法观是习近平法治思想的有机组成部分。习近平法治思想认为,公正是中国特色社会主义司法的灵魂与生命,“以人民为中心”是其根本价值立场,坚持党的领导是我国实现公正司法的根本保障。习近平公正司法观是在马列主义公正司法思想的基础上,汲取传统优秀律政文化的精华,经过中国共产党人的实践探索后形成的现代法治思想。习近平公正司法观具有很强的实践性,是我国实现公正司法的“路向标”。我们需要通过厘清司法机关的政治属性,正确处理党的领导与全面依法治国之间的关系,构建人民群众参与和监督公正司法的机制,推进司法体制改革,加强政法机关的自身建设,以推动我国公正司法的实现。
The concept of fair justice is an organic component of XI Jin-ping's thought of rule of law.XI Jin-ping's thought of rule of law that justice is the soul and life of socialism with Chinese characteristics justice;putting the people at the center is its fundamental value stance,and adhering to the leadership of the Party is the fundamental guarantee for China to achieve fair justice.XI Jin-ping's concept of fair justice is the crystallization of modern rule of law thought,which is based on the Marxist Leninist justice thought,absorbs the essence of Chinese and foreign traditional excellent legal culture,and is the crystallization of modern rule of law thought condensed after the practice and exploration of the CPC people.XI Jin-ping's concept of fair justice is highly practical and has become the roadmap for China to achieve fair justice.Therefore,we need to clarify the political attributes of the judiciary and correctly handle the relationship between the leadership of the Party and the comprehensive rule of law;establishing a mechanism for the participation and supervision of the people in fair justice;promote the reform of the judicial system and strengthen the self-construction of political and legal organs to promote the realization of fair justice in China.
