摘要
进入数字经济时代以来,以企业衍生数据为代表的数据要素市场化配置改革正在引领新一波技术产业革命。如何厘清衍生数据脉络、界定衍生数据权属、保护数据主体合法权益,成为提升北京数字经济治理法治化水平的重要课题。近年来,北京市在国家有关部门的指导下,从制定完善政策法规、促进平台经济健康发展、培育数据要素市场、完善多元治理格局等方面探索构建数字经济治理体系,取得显著实践成效。在北京市数字经济治理体系框架下,分析了企业衍生数据的定义、特点及其生命周期,重点探讨了平台经济、元宇宙等数字经济领域的企业衍生数据法律保护问题,从数据伦理、个人信息保护、数据权属、数据安全四个层面构建出企业衍生数据法律保护体系,根据不同数据主体的权利需求建立不同的权利保护机制,针对不同的保护侧重点,建立内容来源权、持有权、加工使用权和经营权四维的权利配置体系。
Since entering the era of the digital economy,the market-oriented allocation reform of data elements,represented by enterprise-derived data,has been leading a new wave of technological industry revolution.How to clarify the context of derived data,define the ownership of derived data,and protect the legitimate rights and interests of data subjects has become an important subject to improve the rule of law in Beijing's digital economy governance.In recent years,guided by relevant national departments,Beijing has explored the construction of a digital economy governance system,focusing on formulating and improving policies and regulations,promoting the healthy development of the platform economy,cultivating the data element market,and enhancing a diversified governance pattern.Hence remarkable practical achievements have been made.Under the framework of Beijing digital economy governance system,the definition,characteristics,and life cycle of enterprise-derived data are analyzed,with a specific emphasis on exploring the legal protection issues concerning enterprise-derived data in areas such as the platform economy and'the Metaverse.The legal protection system for enterprise-derived data is constructed based on four dimensions:data ethics,personal information protection,data ownership and data security.Different rights protection mechanisms are established according to the rights needs of different data subjects,which include content source rights,ownership,processing rights and management rights.
