摘要
最高人民法院、最高人民检察院、中国海警局联合发布《依法打击涉海砂违法犯罪座谈会纪要》,就审理此类案件具体适用法律的若干问题提出了具体意见。该纪要深入贯彻习近平生态文明思想、习近平法治思想,坚持依法从严惩处总基调,坚持宽严相济基本刑事政策,坚持问题导向,坚持协调统一和配合协作,就盗采海砂违法犯罪中的罪名适用、上游犯罪成立的证据认定、主观故意认定、劳务人员的责任认定、犯罪工具和涉案财物处置等法律适用问题作出规定。
The Supreme People's Court,the Supreme People's Procuratorate,and the China Coast Guard jointly released the"Minutes of the Symposiums on Issues concerning Cracking down on Illegal Mining of Sea Sand in Accordance with the Law",providing specific opinions on several issues related to the specific application of law in such cases.Grasping and Implementing Xi Jinping Thought on Ecological Civilization,Xi Jinping Thought on the Rule of Law,the Minutes adheres to the general principle of strict punishment in accordance with the law,the basic criminal policy of combining leniency with severity and problem orientation,mainly focusing on the application of charges,the determination of evidence,subjective intent determination,the responsibility of labor personnel,the disposal of criminal tools and property involved,and other legal application issues.
