摘要 我国高校学位授予标准的正当逻辑众多纷纭,司法领域普遍采用立法授权范围内的学术自治说,但既有理论皆存在显著逻辑缺陷。高校学位授予标准的正当逻辑应进行理论重构,确立“双重正当逻辑”:学术标准的正当逻辑,即高校的学术自治,高校可自主设定学术标准,国家对此应表示尊重;非学术标准的正当逻辑,即国家因肩负教育监管职责而实施立法授权,高校对此不享有自由增设权。立法即是通过赋予高校公法人地位来实现此类纠纷的行政可诉性。高校学位授予学术标准的设置应遵循学术自治固有的以及公法人内在的限制性原则,法院适用适度的实质审理;非学术标准的设置应遵循法律保留原则,法院适用彻底的实质审理。 There are many propositions about the reasonable logic of the degree awarding standards in col⁃leges and universities in China.The courts generally adopt the academic autonomy logic within the scope of the authorization of laws.However,the existing theories have obvious logical defects.The degree awarding stan⁃dards in colleges and universities have“dual reasonable logic”:the reasonable logic of academic standards is the academic autonomy of colleges and universities;the reasonable logic of non-academic standards is legisla⁃tive authorization.The legislation can realize the administrative justiciability of such disputes by giving colleges and universities the status of public jurists.The setting of academic standards for degree awarding in colleges and universities should follow the internal restrictive principle,and the court should apply the form of trial to it;the setting of non-academic standards should follow the external restrictive principle,and the court should ap⁃ply substantive trial to it.
